Terms of Service

These Terms of Service ("Terms") govern your access to and use of Rushed AI's website, dashboard, coding workspace, AI features, billing flows, GitHub import/export functionality, and related services (collectively, the "Services").
1. Acceptance of Terms
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
If you use the Services on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.
2. Eligibility and Accounts
You must provide accurate information when creating or accessing an account and must keep your credentials secure.
You are responsible for:
- all activity under your account;
- maintaining the confidentiality of your login credentials;
- ensuring that your use of the Services complies with applicable law.
We may suspend or terminate access if we reasonably believe your account is being used in violation of these Terms, applicable law, or the security of the Services.
3. The Services
Rushed AI provides a browser-based coding environment with AI-assisted development features, including:
- project creation and management;
- file and folder editing and storage;
- AI conversations that can read and modify project files;
- quick-edit tooling for code changes;
- browser preview functionality;
- GitHub repository import and export;
- subscription and credit-based usage controls.
Features may change over time and may be added, modified, limited, or removed without notice.
4. User Content
You retain responsibility for the prompts, code, files, repositories, URLs, and other content you submit, import, generate, or export through the Services ("User Content").
You represent and warrant that:
- you have all rights necessary to submit and use your User Content with the Services;
- your User Content and use of the Services do not violate any law, contract, intellectual property right, privacy right, or other third-party right;
- you have permission to access and process any repositories, websites, documentation, or other materials you provide to the Services.
You grant us a limited right to host, store, reproduce, transmit, process, modify, and display User Content only as necessary to operate, maintain, secure, and improve the Services.
5. AI Output
The Services may generate code, text, recommendations, edits, or other output using AI systems ("Output").
You understand and agree that:
- Output may be incorrect, incomplete, insecure, or unsuitable for your specific use case;
- Output may require human review, testing, and validation before use;
- we do not guarantee that Output will be original, accurate, merchantable, non-infringing, or fit for any purpose;
- you are solely responsible for reviewing and deciding whether to use any Output.
This is especially important for production systems, security-sensitive code, compliance-sensitive workflows, and legal, financial, medical, or safety-related contexts.
6. Acceptable Use
You may not use the Services to:
- violate any law or regulation;
- infringe or misappropriate intellectual property, privacy, publicity, or other rights;
- upload, generate, or distribute malware, destructive code, or unauthorized access tooling;
- attempt to gain unauthorized access to systems, accounts, repositories, or data;
- interfere with or disrupt the integrity or performance of the Services;
- abuse, bypass, or attempt to circumvent usage limits, billing controls, or access restrictions;
- use the Services for spam, fraud, harassment, or deceptive practices;
- submit content you do not have the right to process.
We may investigate violations and suspend or terminate access accordingly.
7. GitHub and External Integrations
If you connect GitHub or use import/export features:
- you authorize the Services to use the access available through your connected account to perform the actions you request;
- you are responsible for ensuring you have rights to import repository content and create or modify destination repositories;
- exported repositories, imports, and connected-provider actions are performed at your direction and risk.
If you provide URLs for scraping or reference, you are responsible for ensuring you have permission to access and use that material.
8. Subscriptions, Credits, and Payments
Certain features require an active paid subscription or sufficient credits.
Current product behavior includes:
- recurring subscription plans with monthly credit allocations;
- daily credit and token usage caps by plan;
- optional one-time credit pack purchases;
- credit deductions tied to AI usage;
- plan or payment-state restrictions on some features.
Prices, plan features, credit allocations, and usage rules may change at any time.
Payments are processed by third-party providers. By making a purchase, you agree to the payment provider's applicable terms and authorization requirements.
Unless otherwise required by law or expressly stated by us:
- fees are non-refundable;
- unused subscription periods do not create ownership rights in the Services;
- credits are a limited-use feature within the Services and are not money, stored value, or property.
9. Suspension and Termination
We may suspend or terminate your access to all or part of the Services at any time, with or without notice, if:
- you violate these Terms;
- your use presents security, legal, or operational risk;
- required payments are not completed;
- a third-party provider disables required infrastructure or access.
You may stop using the Services at any time. Termination does not relieve you of payment obligations already incurred.
10. Intellectual Property
The Services, including software, design, branding, interfaces, and underlying technology, are owned by Rushed AI or its licensors and are protected by applicable intellectual property laws.
Except for the limited rights expressly granted in these Terms, no rights are granted to you by implication or otherwise.
11. Feedback
If you provide suggestions, ideas, or feedback, we may use them without restriction or compensation to you.
12. Availability and Changes
We do not guarantee that the Services, or any feature of the Services, will always be available, uninterrupted, secure, or error-free.
We may:
- modify or discontinue features;
- impose or change feature limits;
- update supported plans, providers, models, or integrations;
- perform maintenance that temporarily affects availability.
13. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND QUIET ENJOYMENT.
WE DO NOT WARRANT THAT:
- THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE;
- OUTPUT WILL BE ACCURATE, RELIABLE, OR SAFE;
- IMPORTED, EXPORTED, OR GENERATED CODE WILL FUNCTION AS EXPECTED;
- THE SERVICES WILL MEET YOUR REQUIREMENTS OR COMPLIANCE OBLIGATIONS.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUSHED AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
- USD $100.
Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
15. Indemnity
You agree to defend, indemnify, and hold harmless Rushed AI and its affiliates, officers, employees, contractors, licensors, and service providers from and against claims, liabilities, damages, judgments, losses, and expenses arising out of or related to:
- your User Content;
- your use of the Services;
- your violation of these Terms; or
- your violation of any law or third-party right.
16. Governing Law and Disputes
These Terms are governed by the laws that apply in the jurisdiction where the Services operator is established, without regard to conflict-of-law rules, except where applicable law requires otherwise.
You and Rushed AI agree to submit disputes arising out of or relating to these Terms or the Services to the courts of competent jurisdiction serving that location, except where applicable law provides a different forum or process.
17. Changes to These Terms
We may update these Terms from time to time. Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms, except where additional consent is required by law.
